TERMS AND CONDITIONS

GENERAL TERMS AND CONDITIONS BEWUSTZINGEN.NL

To ensure our collaboration runs smoothly, we kindly ask you to carefully read the conditions below. By enrolling, you agree to these conditions. Thank you for your understanding and cooperation!

1. Course Period and Holidays

1.1 The course period runs from the end of August until July of the following year.

1.2 Enrollment is possible at any time during the year.

1.3 The holiday schedule follows school holidays and public holidays. During these periods, no lessons will take place unless otherwise agreed.

2. Subscriptions and Lesson Packages

2.1 Subscriptions are available for singing/music lessons combined with personal coaching.

2.2 Available formats and lesson quantities:

a. Full course year (36 weeks):

  • 36 lessons of 60 minutes (1 per week).
  • 36 lessons of 30 minutes (1 per week).
  • 18 lessons of 60 minutes (1 every 2 weeks).

b. Half course year (18 weeks):

  • 18 lessons of 60 minutes (1 per week).
  • 18 lessons of 30 minutes (1 per week).
  • 9 lessons of 60 minutes (1 every 2 weeks).

c. Lesson Card (valid for 6 months):

  • Lesson Card 30: 10 lessons of 30 minutes or 5 lessons of 60 minutes.
  • Lesson Card 60: 10 lessons of 60 minutes.

Lesson cards are strictly valid for 6 months from the first lesson date. Any unused lessons within this period expire and will not be refunded. Exceptions can only be made in consultation and in case of force majeure (article 7.2).

2.3 For more information on rates, see the Services & Rates page on the website.

2.4 All lessons are scheduled based on availability of both the coach and the student, in consultation.

2.5 When enrolling for a full or half course year, a fixed lesson slot is reserved. This slot expires in case of persistent payment arrears or termination of the program.

The reservation of a fixed lesson slot means that this time remains exclusively reserved for the student throughout the program and cannot be given to other students.

2.6 Lesson schedules may be adjusted if both the student and the coach agree to this in writing.

3. Enrollment

3.1 Enrollment is possible for:

  • A full course year,
  • A half course year, or
  • A lesson card (valid for 6 months).

3.2 Enrollment takes place via the digital registration form on the website.

3.3 Sessions start only after receipt of the fully completed form and confirmation of enrollment.

4. Rates and Payment

4.1 Payment options:

  • One-time payment of the full amount.
  • Installment payment (monthly), to be set up by the student via their own bank.
  • Direct debit (additional €0.30 per installment; see Services & Rates for details).
  • Cash payment prior to the lesson.

The student is responsible for timely execution of payments.

4.2 All invoices must be paid within 7 days of the invoice date. For installment payments, the first installment must be paid within 7 days of the invoice date. The remaining installments are then due monthly on the same date.

Payments must be made to the IBAN number stated on the invoice, in the name of BEWUST Zingen, with the invoice number as reference.

4.3 Each invoice states the full course amount and a unique invoice number. For installment payments, this invoice number remains the same, and the agreed installment amount is applied.

The payment obligation applies to all agreed installments, regardless of early termination of participation.

4.4 In case of late payment, the student receives a payment reminder. If a second reminder is required, administrative costs of €5 per invoice will be charged, including for adjustments requested by the student (such as credit notes upon early termination).

4.5 If payment arrears exceed three months, lessons will be suspended until the outstanding amount has been paid in full.

4.6 Enrollment for a full course year, half course year, or lesson card entails an unconditional payment obligation for the full course fee, regardless of the number of lessons actually attended.

The reserved lesson slot remains available for the student throughout the entire program. Even in case of early termination or absence, the full course fee remains due, unless an exception is made under article 7.1 or 7.2 and confirmed in writing.

4.7 If payment arrears exceed three months, BEWUST Zingen reserves the right to demand full payment of the remaining course fee immediately and to terminate the program. In this case, the right to further participation in lessons expires, but the payment obligation remains in force.

4.8 The current rates are always listed on the Services & Rates page of the website.

4.9 Each invoice contains clear payment instructions. Please follow these carefully.

5. Cancellation and Rescheduling of Lessons

5.1 Lessons can be canceled at least 24 hours in advance. Cancellation is considered timely if it is communicated in writing (by e-mail or WhatsApp) at least 24 hours before the lesson and confirmed by BEWUST Zingen.

5.2 A maximum of two rescheduled lessons is allowed per subscription.

5.3 Beyond two cancellations, the right to rescheduling expires and the missed lesson will still be charged.

5.4 Absence without notice is defined as failing to appear for a scheduled lesson without timely cancellation (less than 24 hours in advance) and without informing the coach. Such lessons are considered taken and will be charged in full. The right to rescheduling is forfeited in these cases.

5.5 Rescheduling of planned lessons is only possible by mutual written agreement.

If an ongoing program is terminated early at the student’s request, a credit note may be issued for the remaining part of the program if BEWUST Zingen agrees in writing. An administration fee of €5 will be charged unless otherwise agreed.

Note: This is only possible in exceptional cases and does not automatically entitle to a refund. The original payment obligation remains in force, in accordance with article 4.6, unless a situation as described in article 7.1 or 7.2 applies.

6. Coach Absence

6.1 In case of illness or absence of the coach, the missed lesson will be rescheduled.

6.2 If otherwise agreed, the written or verbal agreement applies.

7. Termination and Force Majeure

7.1 Early termination is possible in the following cases:

  • Long-term illness (with medical certificate), or
  • Relocation outside the region.

Termination under this article must be requested in writing (by e-mail) and only takes effect after written confirmation from BEWUST Zingen.

7.2 In cases of force majeure (such as pregnancy, pandemics, or other exceptional circumstances), a suitable solution will be sought in consultation.

These cases do not entitle to a refund unless otherwise agreed in writing.

8. Location

8.1 Lessons take place at the location provided by BEWUST Zingen or, if agreed, online.

9. Liability

9.1 BEWUST Zingen is not liable for loss, theft, or damage of personal belongings during lessons.

9.2 Damage to property or equipment of BEWUST Zingen caused by intent, gross negligence, or improper use by the student or their companions will be charged to the responsible person. In case of accidental damage or unforeseen circumstances, a suitable solution will be sought in consultation.

10. Amendments to Terms

10.1 BEWUST Zingen reserves the right to amend these terms and conditions and course fees.

10.2 Amendments will be communicated in writing and will not take effect earlier than 30 days after announcement.

These terms and conditions are effective as of June 8, 2025, with articles 2.5, 2.6, and 5.5 added.
